Non-binding Arbitration

Non-binding arbitration is a court ordered alternative dispute resolution method designed to help litigants test their legal theories and obtain an order on the merits of their case, without the vast majority of the formalities of trial. Like mediation, non-binding arbitration involves a third-party neutral working to help resolve your case. Unlike mediation, the arbitrator acts more like a judge, and recommendations provided to a court on non-binding arbitrations are not necessarily the end of your case if you lose.

Binding Arbitration

This is usually brought about under contract between the parties. Binding arbitration is similar to non-binding arbitration, except that there is nearly no recourse to the litigants if the case is lost. Contract drafters are cautioned to lock parties into binding arbitration.
